Eviction Prevention: Advocating for Shelter Residents

Through the Shelter Client Advocacy program, EDC monitors conditions and the application of shelter rules in San Francisco and defends residents who are at risk of being evicted from shelters. When issues arise between shelters and their clients, EDC acts as an informal conflict resolution agency and assists clients when they are appealing shelter decisions that deny them service. Ultimately, EDC’s role is to protect shelter residents from eviction. 

Our work includes a formal grievance process, providing shelter residents who have been denied services a pathway towards resolution. The first step is an internal shelter hearing, conducted by shelter management. If a client disagrees with the outcome of this hearing, they can appeal to an arbitration. The arbitrators are attorneys and act as neutral parties on a volunteer basis. The arbitrators’ decisions are final, but it is important to note that clients do not waive any of their legal rights by participating in this process. 

This unique process aims to prevent people from losing access to homeless shelters– a last resort for many people without other housing options. A recent analysis of our work indicates that following the process to its conclusion has a positive outcome for clients (either the denial of service is overturned, or the penalty length is modified) almost 70% of the time.
